			<description><![CDATA[<p>/India PRwire/ - Stepping up its efforts to curb the menace of counterfeit products in the market, India&#8217;s leading FMCG Company Dabur India Ltd, along with local authorities, has busted a racket involving manufacture of spurious Dabur Amla Hair Oil in the national capital.</p><p>Raids were conducted by officials of Delhi Police on two units involved in the manufacture &amp; printing of fake Dabur Amla Hair Oil bottles and labels. The raids conducted at Modern Bazaar, Gali Petiwali, Sadar Bazar and 5657, Gali No. 7, Multani Dhanda, Pahar Ganj also led to the arrest of the accused - Surender Jain &amp; Munawar Ali. </p><p>An FIR has also been filed (No. 166 of 2008) and registered with the Pahar Ganj Police Station. During this raid, around 75, 000 labels of Dabur Amla Hair Oil, (100 ml. &amp; 200 ml.), 4 Master Plates and 2 offset machines have been seized. From the premise of Surender Jain, over 11,000 bottles of Dabur Amla were seized.</p><p>Dabur India has been targeting counterfeit products manufacturers across the country. Through the initiatives of Dabur India, raids have been conducted in Delhi, Kolkata, Agra amongst other cities. Goods worth over Rs One Crore have been seized so far through these raids.</p><p>A Dabur India spokesperson said the Company is targeting spurious and fake products manufacturers in a planned manner. Leads have been obtained on packaging and label suppliers as well, and Dabur India will spare no efforts to get them behind bars. 			<description><![CDATA[<p>/India PRwire/ - Till the year 2005, most Hotels and Restaurants were obtaining Cable T.V. connection from the local T.V. cable operator for supply of T.V. channels, at prices determined between themselves. The system continues even today. A few big chain Hotels have set up their own cable T.V. reception equipments and they obtain signals directly from the Broadcasters. In the middle of 2005, the Broadcasters and their agents unilaterally decided to raise the tariff for their channels and started asking Hotels and Restaurants across the country to have agreements directly with the Broadcasters by paying exorbitant charges.</p><p>The Association on behalf of its members, requested the Broadcasters to be reasonable in their demand and also requested them to allow the Hotels and Restaurants to receive the signals from the local cable operators who are providing the services, as it was beyond their means to install equipments and obtain the signals directly from the Broadcasters The Broadcasters and their agents refused the request of the Association and hence the Association had to take recourse to the legal remedy. Accordingly, it approached TDSAT, for resolving the dispute. TDSAT while admitting the Petition of the Association, granted a stay and Hotels and Restaurants were therefore required to pay the tariff as was prevailing in 2005. In the meanwhile, the Broadcasters and their agents continued to take coercive actions against Hotels and Restaurants compelling them to pay exorbitant charges. TDSAT thereafter delivered its Judgment at the beginning of 2006, holding that Hotels and Restaurants are not consumers. The sheer un-reasonability of this Judgement compelled the Association to move an Appeal in Supreme Court of India, which thereafter ruled in November 2006 that <strong>Hotels and Restaurants are indeed consumers</strong>. The Supreme Court, therefore directed TDSAT to dispose off the Petition filed by the Association on that basis. In November 2006 TRAI for the first time issued a notification prescribing the tariff for domestic consumers. While doing so, TRAI excluded the following categories of Hotels from the tariff regime and these Hotels were left to discretion of negotiating skills between the Broadcasters and the subject Hotels.</p><p>a) Hotels with 50 rooms and above.</p><p>b) Hotels with a ranking of 3 Star and above.</p><p>c) Heritage Hotels.</p><p>Aggrieved by the notification, FHRAI the apex body moved TDSAT challenging the discriminatory treatment. After several hearings, TDSAT is yet to announce its ruling in the matter. In the meanwhile, TDSAT ruled that no coercive actions can be taken by the Broadcasters against Hotels. As things stand </p><p>today, all consumers both Residential and Hotels &amp; Restaurants except the excluded category listed above, pay the tariff as per the TRAI notification, amended from time to time, both in CAS and non-CAS areas. Recently, the Broadcasters have once again started taking coercive actions against Hotels and Restaurants, by instituting criminal cases against them for copy-right infringement. 			<description><![CDATA[/India PRwire/ - After the disengagement of Hero Cycles and Hero Exports from Ultra Motor India, the honourable Delhi High Court has upheld the exclusivity clause between Hero Cycles and Ultra Motors in relation to sourcing electric vehicle kits (Battery, Motor and Controller) from anyone but Ultra Motor for a period of 180 days starting April 23, 2008.Ultra Motor Company can be the ONLY Electric Vehicle Kit Supplier to Hero Cycles or any of its affiliates. In its judgement, the High Court also observed that the exclusivity clause would apply to Hero for a period of 180 days. As per the exclusivity clause, Hero is required to procure similar products only from Ultra Motor. Both Hero Cycles Limited &amp; Ultra Motor India, would be bound by the stipulations in Clauses 7.1, 7.2, and 7.4 of the Agreement for Technical Collaboration and Joint Marketing dated September 29, 2006. <p><strong><em>&#8220;7.1: This is an exclusive agreement. Subject to Clause 2.6, HCL shall not seek to procure or actually procure similar products of the same category EV Kit, from any third party, other than UMIL during the term of this agreement.&#8221; </em></strong></p><p>While the High Court judgement restrains Ultra Motor from selling specified Low Speed E-Bikes (or products of equivalent specification as mentioned in the original agreement) the honourable High Court&#8217;s judgment does not include any high powered, high range and high speed e-scooters which have a battery configuration of 48V/20 AH and above, which are outside the arrangement between the parties. Vehicles running on this power pack specification are commonly known as e-scooter and e-scooter plus. Prior to disengagement these vehicles were available under the model name Maxi (48V/20AH) and Velociti (48V/24AH).The latest trends in Electric two wheeler industry is skewed towards high powered, high range and high speed electric scooter. 			<description><![CDATA[<p>/India PRwire/ - Rajender Joshi, a wildlife trader belonging to Jalpaiguri district along Indo-Bhutan border in West Bengal, was today sentenced to four years in prison along with a fine of 10,000 rupees. Joshi, son-in-law of the notorious Ratiram Sharma, was accused of possessing and trading in wildlife articles. </p>                   <p>Joshi was arrested from his residence in Jaigaon on August 9, 2006 in a raid conducted by a team of forest and police officials led by Suranjan Sarkar, Range Officer, Kodal Basti Range under the supervision of Utpal Kumar Nag, Assistant DFO, Coochbehar Division. Ivory including a circular section of the tusk and a hog deer skin was recovered from his possession. </p>                                                                                                                                                                          <p> final arguments in the case started on February 13 and were led by Saurabh Sharma, Advocate of the Wildlife Trust of India (WTI), who was appointed asAdditionalProsecutor by the State Government to argue the case on behalf of the forest department. He was assisted by Samir Majumdar, Additional Public Prosecutor, Alipurduar. </p>                   <p>&#8220;There were five prosecution witnesses and six defence witnesses in this case which was hotly contested. Finally, justice has been delivered in a relatively short time with indispensable support fromDrPCBhutia (CF), MC Biswas (DFO, Coochbehar) and WTI,&#8221; said Sharma, following the judgement. </p>                   <p>&#8220;Punishment to wildlife traders and that too in such a short time increases the faith of the common man on the judicial system of the country,&#8221; said Nag, after the Additional Chief Judicial Magistrate of Alipurduar, West Bengal, Nirvan Kheshang, handed out the sentence.</p>                                                                                                                                                                                           <p>The accused reportedly functioned from his residence in Jaigaon, an important transit point in the wildlife trade route from India to south-east Asian countries. During interrogation, he had revealed that wildlife articles were brought in from Uttaranchal, Rajasthan, Haryana and the north-eastern states and taken to the customers via Bhutan and Nepal with Jaigaon and Siliguri being the respective transit points. He had also revealed that the circular section of tusk seized from his possession was mainly used a sample for the customers in China, Singapore and Thailand. </p>                                                                                        This is the third wildlife crime case involving Schedule I species in three consecutive years where WTI assisted the West Bengal forest department in successful conviction of the accused. In November 2006, Ratiram Sharma, a notorious wildlife trader and Joshi&#8217;s father-in-law, was convicted and sentenced to five years RI. On 23-1-2008 the Hon&#39;ble   Court issued notice against RGV Film Factory Private Limited and RGV Films Private Limited and issued summons asking them to appear and defend the suit.</p><p>Instead of developing the case against him RGV has been going to press claiming that documents are forged and fabricated. He has not specified exactly which document is forged and fabricated. How can an agreement for 14 films which stands acted upon in respect of 4 films suddenly become forged or fabricated in respect of remaining films.</p><p>RGV had firstly filed a complaint with Jt. 			<description><![CDATA[<p>/India PRwire/ - The proposed changes include the relaxing of the prohibition on dogs at a number of locations, including the Promenade at Lahinch: on the spot fine increases, a new system of penalties for breaches of event/activity licenses and the introduction of detailed signage at beaches targeted by the laws. </p><p>Areas presently covered by the bye-laws include littering, lighting of fires, removal of beach materials and protected species; nuisance; the bringing on to and parking of vehicles on beaches; camping on beaches; trading; control of animals; commercial filming; and regulation on the use of motorized craft and of water sports activities. </p><p>The byelaws apply to the beaches at Bishopsquarter (Ballyvaughan), Fanore, Doolin, Tr&#225; Leathan (Doolin), Lahinch, Whitestrand (Miltown Malbay), Spanish Point, Doughmore (Doonbeg), Whitestrand (Doonbeg), Carrigaholt, Brew&#8217;s Bridge (Kilrush), Ballycuggeran (Killaloe) and Mountshannon. Beaches at Kilkee and Cappa are excluded, as they are in the jurisdictions of Kilkee and Kilrush Town Councils respectively.</p><p>The results of the 5-week public consultation process, which commences this week, will be presented to Council&#39;s the Environment, Emergency Services and Consumer Protection Strategic Policy Committee (SPC) for consideration. The SPC will then recommend the adoption of the Bye-Laws, with or without amendments, to Clare County Council&#39;s elected representatives before they are officially passed into law. </p><p>SPC Chair Councillor Tommy Brennan described the proposed amendments to the Beach Bye-Laws as an important step towards the improved regulation and management of Clare&#39;s beaches and natural amenities.</p><p>He explained, &#34;I would urge members of the public to carefully consider the proposed amendments to the Bye-Laws, which form part of the Council&#8217;s continuing efforts to improve coastal amenity areas through ongoing coastal protection works, improvements to beach infrastructure and safety equipment, and better regulation of beach use.&#34;</p><p>&#34;While the prohibition on bringing dogs on to beaches in the 13 designated Bye-Law locations is to remain in place, I warmly welcome the proposal to relax the prohibition at promenades and public carparks. I also welcome the requirement that dog owners keep their animals on a leash in the interests of public safety&#34;, added Councillor Brennan.</p><p>Among the other proposed changes to the Bye-Laws, is the provision for the suspension of an event/activity license. Under the current Bye-Laws the only penalty available for breach of a License is its complete withdrawal. The proposed change provides for a more gradual approach to dealing with breaches where this may be deemed more appropriate.</p><p>Meanwhile, on the spot fines will increase from EUR63.50 to EUR75, in line with new legislation, the Local Government Act 2001 (Bye-Laws) Regulations), 2006. The provision of improved public information signage at the 13 locations covered by the Bye-laws is also being proposed.</p><p>Commenting on the impact of the Beach Bye-laws since their introduction on June 1st 2006, Mr. Sean Ward, Senior Engineer, Environment Directorate, Clare County Council, stated, &#34;The approach taken during the 2006 season was to raise awareness and educate rather than to impose strict legal sanctions. A campaign of public awareness was launched through the press and local radio. Signage with pictorial as well as verbal content was erected at all locations.&#34;</p><p>&#34;During the 2007 season, the enforcement approach ensued. The Council&#39;s Environmental Patrol Wardens were the main agents of enforcement, assisted in Lahinch by the local traffic warden. The Water Safety Officer also made frequent visits at weekends to all the beaches covered by the Bye-Laws. Assistance was also received from the Garda&#237; when required&#34;, he said.</p><p>Mr. Ward stated that the Beach Bye-Laws were well observed by beach users. A total of 14 fines issued with the majority relating to for driving, bringing, placing on, or leaving vehicles on the beach or dune system appurtenant to the beach. Three fines were issued for animal related offences.</p><p>He added, &#34;Clare County Council and An Garda S&#237;och&#225;na have been greatly assisted in ridding the county&#39;s coastal amenity areas of nuisances. However, as with all legislation, the Council is seeking to make the Bye-laws even more effective by introducing a set a of proposed amendments.&#34;</p><p>&#34;It is necessary to introduce all of these bye-laws in the interest of safety of persons using our beaches, to properly manage different beach activities, to protect the ecology of sensitive habitats and to ensure continuing success in achieving Blue Flag Status for our beaches. 			<description><![CDATA[<p>/India PRwire/ - Clare County Council&#8217;s Casual Trading Draft Bylaws were removed from public display today having been viewed by hundreds of people since late November. </p><p>The revised bylaws include the formal designation of casual trading areas in Ennistymon, Doolin Pier, Kildysart, Kilfenora, Killaloe, Kilkee, Miltown Malbay, Shannon and Tulla. The effect of designation is that any trading outside of the designated areas, on public property, is prohibited. </p><p>Separate Event Trading licences will be required by traders wishing to trade at festivals, fairs and significant events in towns and villages throughout Clare. Events include the Willie Clancy Festival in Miltown Malbay each July, the Lisdoonvarna Matchmaking Festival each September, the Rose of Clare Festival at Cooraclare and the Feakle festival. </p><p>The bylaws propose that the Local Authority, in conjunction with local Garda&#237; and local representatives will agree on the number of licences and category of goods that will cater for the needs of such events and pitches/bays will be allocated to successful applicants. </p><p>Meanwhile, the draft bylaws also suggest the introduction of additional management measures, including regulating the heights of stalls, hours of operation and updating of fee structures.</p><p>According to Mr. Ger Dollard, Director of Services, Clare County Council, &#8220;Existing Casual Trading Bylaws, introduced by the Local Authority in 1998, are insufficient to deal with the issues that arise in relation to casual trading, in the present day. The revised bylaws will allow a greater level of control over casual trading activity to the benefit of traders and the general public&#8221;.</p><p>Mr. Dollard explained that Clare County Council has, for some time, been aware of significant difficulties being experienced with casual trading in the county. </p><p>&#8220;These draft bylaws are not designed to remove traders from their current locations. They simply form part of a process, whereby systems governing casual trading activity are continually reviewed and regulated&#8221;, he continued.</p><p>The 1995 Casual Trading Act transferred the responsibility for issuing Casual Trading licenses from the Department of the Environment &amp; Local Government to the individual local authorities. In 1998, Clare County Council adopted bylaws under the Casual Trading Act 1995. </p><p>Mr. James Barry, Senior Staff Officer, Ennistymon Area Office, Clare County Council added, &#8220;The 1998 Casual Trading Bylaws did not formally designate areas for trading throughout the County but permitted such trading on a general basis at any location in the County. Following extensive discussions and consultation, at area committee level, draft Bylaws have now been prepared.&#8221;</p><p>Written comments should be forwarded to Senior Staff Officer, Ennistymon Area Office, Ennis Road, Ennistymon. Submissions received before 4pm on 1st February 2008 will be taken into consideration.</p><p>The Act also provides that any person who is aggrieved by any proposed bylaws may, within 21 days from publication of the notice, appeal to the District Court against the proposed bylaws. 			<description><![CDATA[<p>/India PRwire/ - <em></em>Sical Logistics Ltd (BSE: 520086 NSE: SICAL Reuters: SICA.BO Bloomberg: SIC@IN), India&#8217;s leading provider of integrated multi-modal logistics solutions for bulk and containerized cargo and offshore logistics, has received the order from the Hon&#8217;ble High Court of Madras, sanctioning the de-merger of its non logistics businesses into a wholly owned subsidiary, Sicagen India Limited, with effect from 1 October 2006. </p><p>The approval marks the successful completion of the de-merger process which was initiated by Sical in the beginning of 2007. The de-merger is an important step in the company&#8217;s restructuring efforts and will enable dedicated focus on its core business of bulk, container and offshore logistics.</p><p>As per the Scheme sanctioned by the Hon&#8217; ble High Court, all the shareholders of Sical will be allotted one equity share in Sicagen at a premium of Rs.74.50 per share, credited as fully paid up for every one share held in Sical. The present issued, subscribed and paid up equity share capital of Sicagen is Rs 5 lac with 50,000 shares of Rs 10 each. The entire paid up capital of Sicagen is currently held by Sical and its nominees. </p><p>The equity shares of Sicagen will be listed in the Bombay and National Stock Exchanges, subject to necessary compliance of statutory and listing requirements. The new equity share holders of Sicagen will rank pari pasu for dividends, voting rights at par with the equity holders of Sical.</p><p>As a result of the de-merger, Sicagen will consist of trading and service undertakings and coffee plantations. The trading companies will consist of Building materials and Vehicle sales while the services undertakings will consist of Travel related services, Ship building and repairs, Governor services and Windmill generation. The assets and liabilities of the said undertakings will be transferred to Sicagen, at the values appearing on the books of Sical as of 30 September &#8216;06. The transfer will include all movable and immovable assets, liabilities, including all intellectual property rights, books, records and requisite documents pertaining to the business of the company.</p><p>On the demerger, Ashwin C Muthiah, Chairman, Sical Logistics said, <em>&#8220;I am delighted at the successful completion of the de-merger of our non-logistics business. The company filed the applications before the High Court of Madras for approving a Scheme of Arrangement (de-merger) between Sical and Sicagen on 29 July &#8216;07, after obtaining the No Objection from the National Stock Exchange and Bombay Stock Exchange.
