Admiralty Judge the Hon’ble Dr. D.Y. Chandrachud of the Bombay High Court ordered arrest of Bangladesh flag vessel m.v.Rahman Noor Rahim ex. Eid-A-Mostafa on March 3, 2008 at Kakinada, Andhra Pradesh after hearing counsel Rahul N appearing along with Shrikant Hathi instructed by Plaintiffs’ attorney LEX Nexus., Advocates & Solicitors, a specialised division of Hathi & Partners.

Solicitor Mr. Shrikant Hathi partner of the law firm Hathi & Partners attending to the file representing thirty nine Plaintiffs being insurance companies, shippers, sellers, consignors, buyers, importers, receivers and consignees of cargoes have instituted the suit for recovery of the sum of US Dollars 4485930=07 which represents the value of the cargoes which were lost when the vessel "AMANAT SHAH" sunk 12 miles off Galle, Sri Lanka on or about 8th September 2006 with the Plaintiffs' cargoes on board the vessel "AMANAT SHAH" for her voyage from Myanmar, Yangon to Mumbai, India.

The first Defendant is a foreign flag vessel "ASRAR-A-MOSTAFA" flying Bangladeshi flag while second Defendant vessel is also a Bangladesh flag vessel “RAHMAN NOOR RAHIM” that changed her name from Eid-A-Mostafa both owned by the same beneficial owner.

The vessels changed ownership for no financial consideration. Mr. Hathi states that agreements without consideration are void under both Indian as well as Bangladeshi laws and have pleaded to "pierce the corporate veil" and or ignore a transaction if it is so obviously carried out in an attempt to avoid liabilities and is not, in reality, a genuine or "arm's length" transaction, but merely a "sham" and/or amounting to a fraud.
