Panamanian flag vessel m.v. Indian Challenger released from arrest by Bombay High Court

Sekhiyo Line Ltd a Japanese based shipping company had arrested Panamanian flag vessel m.v. Indian Challenger (ex. Benefit Wisdom) by an order of the Bombay High Court on December 7, 2007 which was executed at wee hours on December 8, 2007 just before she was about to leave Tuticorin port was released by the vacation judge the Hon'ble Dr. D.Y. Chandrachud on December 29, 2007 on an application made by Shrikant Hathi appearing with Suhail Farooqui instructed by LEX Nexus, Solicitors for Sekhiyo Line Ltd and V. Subramaniam appearing for the vessel, in view of security provided by Protection & Indemnity club at Singapore.

The facts and circumstances that led to arrest of the vessel was that a Time Charterparty agreement dated March 16, 2005 Sekhiyo Line Ltd had taken on hire from Benefit Transport S.A., Taiwan the registered owner of the vessel a single deck bulk carrier motor vessel named m.v. INDIAN CHALLENGER (ex. BENEFIT WISDOM). The vessel was delivered to the Plaintiff on April 30, 2005. This vessel was thereafter sub-chartered. Benefit Transport, the registered owner of the vessel committed a breach of the said Charterparty by abruptly withdrawing the vessel from hire without giving reasons of withdrawal of the vessel. Due to the wrongful withdrawal, of the Defendant vessel the sub-charters got affected and claims have been arisen for the losses and damages suffered.

In view of the security provided, the dispute will be resolved by arbitration at Singapore.
