Mahindra & Mahindra Completes Briefing on Motion to Dismiss the Groundless Lawsuit Filed by Global Vehicles USA, Inc.
Mahindra & Mahindra filed a motion to dismiss the baseless lawsuit by Global Vehicles USA, Inc. on June 28th 2010.
Tweet-- On 28 June 2010, Mahindra & Mahindra (Mahindra) filed a motion to dismiss the lawsuit that Global Vehicles USA, Inc. (GV) filed against Mahindra in the US District Court for the Northern District of Georgia. GV had earlier also initiated arbitration proceedings against Mahindra. On 2nd September 2010, Mahindra filed its final reply brief in support of its motion to dismiss the lawsuit, and the briefing on Mahindra's motion is now complete. The US court may issue a ruling on Mahindra's motion to dismiss at any time.
As explained in Mahindra's pleadings of 28th June 2010, GV's claims are groundless because its agreement with Mahindra automatically expired on June 11, 2010. GV was well aware that the Agreement expired automatically on June 11. The Agreement was clear and unambiguous on this central point and the parties even negotiated two extensions of the expiry date.
As set forth in Mahindra's court filings, Mahindra's view is that the parties agreed to arbitrate disputes arising out of their agreement, and the parties' controversy should be resolved in arbitration. The arbitral tribunal has been constituted and is due to meet shortly.
